1:01 pm PT Barr Pharma: FDA defers decision on plan B over-the-counter applicationþBRL 45.27 -1.04:BRL announced that it has received a letter from the FDA concerning the co's Supplemental New Drug Application (sNDA) seeking Over-the-Counter (OTC) status for its Plan B emergency contraceptive product. The letter states that "the Center for Drug Evaluation and Research ... has completed its review of this application, as amended, and has concluded that the available scientific data are sufficient to support the safe use of Plan B as an OTC product ... for women who are 17 years of age and older." Notwithstanding this clear scientific determination, the FDA has delayed any action on the application. Instead, the FDA informed the co that it intends to seek public comment on issues related to the approval of a product that has OTC status for patients 17 and older and prescription status for patients 16 and under. In its communication with BRL, the FDA did not commit to any timetable for initiating or concluding the rulemaking proceeding.

The Dow, which has been the worst performer this week, held at the 62% retrace of the July/Aug rally at 10383 (session low 10383), the S&P 500 rotated higher after hitting the 38% retrace of the Apr/Aug run at 1204 (session low 1204) while the Nasdaq Comp held just above a minor support at the July gap (2115/2113, session low 2118). Sectors weighing on the action today include: Tobacco -2.7%, Disk Drive -1.7%, Steel -1.3%, REIT -1.2%, Oil Service -1.2%, Oil -1.1%, Banking -1.1%, Natural Gas -1%, Housing -1%.
