| 2:35 pm PT Merix announce suit by SEC (MERX) 6.55 :Co announces that SEC has filed suit in the United States District Court, District of Oregon against two persons, including a non officer employee of Merix, alleging that they violated Section 17(a) of the Securities Act of 1933, Section 10(b) of the Securities Exchange Act of 1934 and Rule 10b-5 thereunder by trading Merix common stock while in possession of material non-public information. The suit does not allege any wrongdoing by Merix.

SunGard is being bought out by a private equity consortium organized by Silver Lake Partners in a deal still pending final approvals.
