1:01 pm PT DepoMed delivers notice of breach to BiovailþDEPO 6.50 +0.02:Co announces that it has delivered a notice to Biovail (BVF) outlining Biovail's material breaches of the parties' 2002 license agreement, as amended, for Glumetza, a once-daily extended release formulation of metformin, approved for the treatment of Type II diabetes. The breach involves the failure of Biovail to make the first commercial sale of the 500 mg strength Glumetza within 120 days of approval in each of Canada and the US as required in the license agreement, and to use diligent efforts in the marketing and selling of the 500 mg strength of Glumetza. Co says "in the United States, Biovail has only informed us that it continues to seek a sub-license partner to take responsibility for sales and marketing. While we are in discussions with Biovail concerning our contractual relationship, we determined it appropriate and prudent to give formal notice of breach."
